Despite persistent warnings from the IRS about dubious Employee Retention Tax Credit (ERC) claims, dentists nationwide are still being inundated with misleading marketing claims promising that they’re guaranteed to receive $28,000 per employee. Promoters, who are self-proclaimed “tax experts,” are spending millions to aggressively market ERC credits using radio and TV ads, email, letters, and social media, hoping to land clients they can then charge 10-25% of the cash received.
Many dentists wonder, “Why didn’t my CPA tell me about this opportunity?” It’s simple – CPAs are bound by a code of professional ethics, and can’t claim tax benefits for clients unless they are likely to prevail if audited. If they violate this rule, they face potential loss of licensure and malpractice claims. Promoters have no code of ethics, no license to lose, and no malpractice insurance to worry about, so they’re free to make outlandish statements!
